[The second will of Pierre Le Serurier - drafted 13 years after a first will, but this second one being considered invalid by the magistrates of St. Thomas. Pierre's brother-in-law, Jacques Smith, therefore urged the magistrates to default to the provisions of the earlier will of 1698 according to his Letter41.]

In the name of God, Father, Son, and Holy Spirit, Amen

I, Pierre Smith, merchant at St. Thomas declare today, infirm of body, but thank God, of sound mind... have made this testament and dispositon of my last will in the form and manner in which I write:

First of all, I pray to God to receive by his mercy my soul to his holy rest after my decease, forgiving me for my sins for the sake of his dear son, Jesus Christ, whose death I embrace as the only remedy for our glory, begging him to accept his divine merit as reward for my great sins.

As for my body I instruct that it be buried and left to the good order of the executor of this my testament to whom I leave it.

As for my temporal goods, I order that, after my death, all my debts be duly and promptly paid, and as I have not had the leisure to pay certain obligations in the will made between my late wife and I, I order the executors of that will to satisfy all this as much as possible.

I give and bequeath to my dear sister Lydia Simmons, wife of Mons. Thomas Simmons, Minister of the Holy Gospel, residing in London, or to his heirs the sum of a thousand pounds Sterling, which will be paid to him from accounts I have in London upon which my executor will, in part, draw jointly on behalf of my other heirs as listed below.

I give and leave to the poor of this island the sum of one hundred piastres which will be paid according to the custom and practicality of the situation.

I give to my brother-in-law Arian Abraham his legacy for the good friendship I had with him and his family the sum of a thousand piastres which will be paid to him as soon as possible.

I give and bequeath to the children, heirs of the late Abraham Abrahamson my other brother-in-law, the same sum of a thousand piastres to provide an amount that will be similarly shared and paid to their tutors for their well-being and upkeep, and paid to them as soon as possible.

I give to the sons and daughters of the late Sir Engel Beverhondt and Susanna Jansen his wife, sister of my deceased wife, the same sum of a thousand piastres so that they will be similarly paid and divided equally among them according to their branches.

As I had planned, if God keeps me alive, to do good to the two boys I have here in my house, and to push them forward if they made themselves worthy by virtue of their virtues, hoping the best for both and that they respond with good intentions, I give them each one thousand piastres, to wit, Pierre Ginilliat, my cousin, the sum of a thousand piastres which he will receive provided that his uncle Jacques Smith, my brother-in-law, finds him wise and able to make good use of this money so that it is spent on raising him as with his own child,
And to Adrian Abrahamson, the sum of a thousand piastres which he will receive under the governance and direction of his father similarly as Peter Ginilliat is under the tutelage of my brother-in-law, Jacques Smith.

Of the remainder of the goods which will remain to me, after the above-mentioned having been executed, I wish and order that it be divided into five equal parts which will be distributed between my brother and my sisters or their heirs, to wit,

To my brother Josia Le Serurier living in St. Quentin, France, or to his heirs a fifth part.
To my sister Elizabeth le Serurier, wife of the Sieur de Cleves, living in Paris, a fifth part or to his heirs.
To my brother-in-law Jacques Smith, who resides here, for and because of his children born to my sister Marie, his wife, as their guardian and raising them, a fifth part.
To my sister Madelaine le Serurier, wife of the Sieur du Montier residing in St. Quentin, or his heirs, a fifth part.
And to my sister Lydie Simmons wife of Sieur Thomas Simmons or his heirs, a fifth part without regard to the legacy of a thousand pounds Sterling that I made her before, provided that she enjoys her fifth part in full herself and also the gift and legacy of one thousand pounds

And since my brother Josiah and my sisters Elizabeth and Madelaine have between them a sum that was to come back to me from the inheritance of our late father, but who never compensated me or the other co-beneficiaries of our late father, I wish and instruct them to give our good brothers a fair and faithful accounting of that inheritance so that what should come back to me will be added to the total amount of what I leave behind to be shared between them all so that everyone obtains his rightful share in accordance with my intentions.

I order, name, appoint and constitute my brother-in-law, Jacques Smith, to be executor of this Testament and to do all the things that need to be done in carrying out my instructions regarding the disposition of my effects and property, leaving all things in his hands so that he may proceed swiftly to dispose of my possessions, including my houses, stores, and other things, according to his best judgment and to the best advantage of my heirs.

Besides the above, I also bequeath to my brother-in-law, Jacques Smith, my two diamond rings, one which I usually wear and which came to me last from France, and another worn by my late wife which had been given to me by my sister Marie, his wife, which I beg him to keep in memory of me.

I declare this to be my last will and Testament, coming into force in its entirety, revoking any other that could be opposed to it in St. Thomas, this third of January 1711.

Je, Pierre Smith, marchand a St. Thomas declarer aujourd'hui, indispose de corps, mais Dieu merci, sain de memoire et sante... ai fait ce testament et dispositon des mes derniere volonte en la forme et maniere qui j'ecrit.

Premeirement je prie Dieu de vouloir recevoir par sa mercy mes aine en son saint repos apres mon deceds, me pardonnant gratuitement mes peches pour l'amour de son cher fils, Jesus Christ dont j'embrasse la mort et passion comme le seul remede a nos ..., le priant de vouloir accepter ce divin merite pour recompense de mes grands peches, pour mon corps j'ordonne qu'il soit ... enterre selon que le trouvera bon et l'ordonner a l'executeur de ce mien testament a qui j'en laisse le soin.

Et pour mes biens temporels, j'en ordonne ainsi q'apres mon deceds toutes mes dettes soient bien deuement et promptement payees et comme je n'ai pas eu le loisir de payer certains Lego faits par le testament entre vif, entre feue ma femme et moi, j'ordonne a Le accutens de ce mien testament de satisfaire a tout cela le plutot possible.

Je donne et legrie a ma chere soeur Lydia Simmons, epouse de Mons. Thomas Simmons, ministre du St. Evangile, demeurent a Londres, ou a ses heritiers la somme de mille livres Sterling, qui lui seront payees des dessier que j'ai a Londres et ce soins egard a la part qu'elle tirera conjointement avec mes autres heritiers comme ci apres sera dit.

Je donne et legue aux pauvre de cette isle la somme de cent piastres qui seront payees a suivant la coutume et pratique en ce cas.

Je donne et legice a mon beau-frere Arian Abraham son pour la bonne amitie que j'ai pour lui et sa famille la somme de mille piastres qui lui seront payee le plutot qu'il se pourra.

Je donne et legue aux l'enfans heritiers de feu Abraham Abrahamson mon autre beau-frere la meme somme de mille piastres pour etre entretenir partagee laquelle somme sera pareillement payee a leur stuteurs pour le bien et advantage desdits en faits le plutot qu'il se poura.

Je donne et Legue aux enfans et heritiers de feu le Sieur Engel Beverhondt et de Susanna Jansen sa femme, soeur de ma defunts femme la meme somme de mille piastres qu'il leur sera semblablement payee pour etre etre entre eux partagee egalement selon leurs branches.

Comme j'avois dessein si Dieu me conserve la vie de faire du bien aux deux garcons que j'ai ici dans ma maison

et de les pousser et advancer s'ils s'en rendoient dignes par lelur vertus, esperent tout bien deux, et qu'ils repondront ames bonnes intentions je leur donne et legace a chacun mille piastres, c'est a dire a Pierre Ginilliat, mon cousin, la somme de mille piastres qu'il ne recevera qu'a mesure et q'autant comme son oncle Jacques Smith, mon beau-frere le trouvera sage et capable de bien user de cette somme le chargement du soin et du pouvoir d'en user avec lui comme avec son propre enfant et a Adrian Abrahamson la somme aussi de mille piastres qu'il recevera sould le gouvernmement et direction de son pere comme Peter Giniliat l'est sous celui de mon beau-frere Jacques Smith.

Dont le restant du bien qui me restera, ce que dessus mentionne etant execute, je veu et ordonne qu'il soit partage en cinq parts egales qui seront distribuees entre mon frere et mes soeurs ou leurs heritiers savoir

A mon frere Josia Le Serurier demeurant a St. Quentin en France ou a ses heritiers une cinquieme partie.
A ma soeur Elizabeth le Serurier, epouse du Sieur de Cleves demeurent a Paris une cinquieme partie ou a ses heritiers.
A mon beau-frere Jacques Smith, demeurent ici pour et a cause de ses enfants nees de ma soeur Marie, sa femme, comme etant leur tuteur et faisant pour eux une cinquieme partie.
A ma soeur Madelaine le Serurier, epouse du Sieur du Montier de votre demeurant a St. Quentin on a ses heritiers une cinquieme partie.
Et a ma soeur Lydie Simmons epouse du Sieur Thomas Simmons on a ses heritiers une cinquieme partie sans egard au legace de mille livres Sterling que je lui fais ci devant, entendent qu'elle dit et jouisse de son cinquieme entier et dudit don et legace de mille livres Sterling
Et comme mon frere Josias, mes soeurs Elizabeth et Madelaine ont entre eux une somme qui me doit revenir de l'heritage de feu mon pere qui n'a jamais ete liquide avec moi ni les autres coheritiers de feu mondit pere j'entend et ordonne qu'ils rendront en bon freres un compte juste et fidel dudit heritage et de ce qui peut me revenir qui sera adjoute a la masse de ce que je laisse pour etre egalement partage entre eux a fin que chacun ait son droit suivant mon intention.

J'ordonne, nomme, appointe et consitue mon beau-frere Jacques Smith pour etre executeur de ce mien Testament et pour faire et gever toutes les affaires qu'il y aura a faire en l'execution de celui ordonerant que touts les effects et biens par moi laisses lui soient laisses et restais en mains pour proceder plutot a l'execution de ce mien Testament comme aussi qu'il reste en possession de toutes mes maisons, magazins, et autres choses qu'il convient tant et aussi longtemps qu'il sera convenable pour parvenir a une fin d'affair et d'execution complete de ce mien testament voulant et entendant qu'il demeure en possession de tout pour le vendre faire vendre et en disposer comme il jugera bon et advantageux pour le bien de mes heritiers.

Je donne autre ce que dessus a mondit beau-frere Jacques Smith mes deux bagues de diamant savoir une que je porte ordinairment et qui m'est venue dernierement de France et une autre que portoit feu ma femme qui lui avoit ete donne par ma soeur Marie sa femme lesquelles je le prie de vouloir garder en memoire de moi.

Je declare que ceci est mon Testament et derniere volonte voulant qu'il ait lieu et force suivant son entierretenu revoquant tout autre qui pouroit y etre contraire fait a St. Thomas ce troizieme Janvier 1711.
